Statement regarding minimum wage news article

Statement regarding Omnia Outsourcing being named by HMRC for not paying NMW in one instance

 

We were shocked and disappointed to discover that we have been named in a press release by HMRC stating a confirmed breach on NMW payment, with no prior communication.
From investigating the circumstances, I would like to confirm our position on the breach as below.

  • The breach occurred 5 years ago; a period covering late May until early July 2021.
  • In the time since, the Ownership and Directorships of the business have changed considerably. This breach was not disclosed by previous incumbents.
  • The “client” in question was given notice by Omnia after a short period of time due to concerns about their conduct.
  • The breach was a result of inaccurate timesheet data supplied by the client to Omnia which is a breach of our TOB’s.
  • Omnia(solely…) worked with the effected employees to gain accurate timesheet data after the termination of our agreement with the client. The workers were paid any “top up” monies promptly on the 3rd of September 2021.
  • Despite Omnia acting in good faith and paying workers based on hours provided by the client, when a shortfall was flagged, Omnia topped the workers wages up in full, at its own cost.
  • Omnia cooperated in full with the enquiry.

 

I trust the above sets out that the circumstances were beyond the control of Omnia Outsourcing. In addition, the new Senior Management team have further strengthened our compliance position with significant investment made in updating/upgrading our infrastructure across the business. Including, but not limited to, upgrading our payroll software to the industry leading provider, becoming SafeRec certified and gaining FCSA membership as well as launching our client portal to provide RTI on our HMRC liability status.

 

We are frustrated that despite full cooperation, payment in full of owed monies that this release has appeared several years after the conclusion of the matter and we are in active discussion with our legal team on the timing of this announcement.
